If you want to place surfactants on the market which do not meet the requirements for ultimate biodegradability (article 5 of the Detergents Regulation), you can get a special exemption for industrial or institutional purposes (= derogation).


When you want to make a request for derogation, you have to submit a technical dossier to the Risk Management Service of the FPS HFCSE and also pay a fee of € 1,000. You have to transfer this fee to the account no. BE65 6792 0059 5996 of the Federal Public Service Health, Food Chain Safety and Environment, DG5, risk management service, Victor Horta Place 40/10, 1060 Brussels (Banque de la Poste - Brussels, BIC: PCHQBEBB). Please incorporate alongside the data of the company also the following: '[name of the considered product(s)] + art.12'.


Article 12 refers to the Royal Decree on paying fees and contributions (in Dutch or French).
